TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of Circuit's website, products, and services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

1. DEFINITIONS

Throughout these Terms, the following definitions apply:

• "Circuit" refers to Circuit, its software, websites, and services operated by Null Incorporated.
• "Services" refers to any products, software, website, Discord server, or other services provided by Circuit.
• "User" or "you" refers to any individual or entity that accesses or uses the Services.
• "Content" refers to any information, data, text, software, graphics, messages, or other materials displayed on or available through the Services.

2. ACCOUNT REGISTRATION AND SECURITY

When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to:

• Maintain the confidentiality of your password and account information
• Immediately notify us of any unauthorized use of your account
• Ensure that you exit from your account at the end of each session
• Not share your account credentials with any third party

We reserve the right to disable any user account at any time if, in our opinion, you have violated any provision of these Terms.

3. USE OF SERVICES

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates any applicable law or regulation
• Use the Services to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
• Use the Services to harm minors in any way
• Use the Services to transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable
• Use the Services to impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity
• Use the Services to upload or transmit any material that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party
• Use the Services to upload or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," or any other form of solicitation
• Use the Services to upload or transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Violate any applicable local, state, national, or international law

4. SOFTWARE AND MOD MENU USE

Circuit software and mod menus are provided for educational and entertainment purposes only. By using our software, you acknowledge and agree that:

• You will comply with the terms of service and end user license agreements of any third-party games or applications
• You use our software at your own risk
• We are not responsible for any consequences resulting from your use of our software, including but not limited to account suspensions, bans, or other penalties imposed by third-party game publishers
• You will not use our software for cheating, harassment, or any form of unfair advantage in online multiplayer games
• You will not attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of our software
• You will not distribute, sell, lease, rent, or otherwise transfer our software to any third party

5. INTELLECTUAL PROPERTY

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Circuit, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your Web browser for display enhancement purposes
• If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications

6. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CIRCUIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CIRCUIT DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CIRCUIT, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Circuit, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

9. TERMINATION

We may terminate or suspend your access to all or part of the Services, including terminating or suspending your account and license to use our software, at any time, with or without cause, with or without notice, effective immediately.

If you wish to terminate your account, you may simply discontinue using the Services, or notify us through our Discord server.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. GOVERNING LAW

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the jurisdiction in which Null Incorporated is established, without giving effect to any choice or conflict of law provision or rule.

11. CHANGES TO TERMS

We may revise these Terms at any time by updating this page. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
